هذه الأحكام تُقرأ مع شروط الاستخدام وسياسة الخصوصية، وتحكم تحديداً كل ما يتعلق بالتوظيف أو الدراسة داخل الولايات المتحدة. وعند التعارض، تسود هذه الوثيقة في المسائل الأمريكية.
١. من نحن — ومن لسنا
DreamBridgeUSA شركة خاصة مستقلة تقدّم خدمات منصّة تقنية. ولتفادي أي التباس:
- لسنا صاحب عمل. لا نوظّف أحداً ولا ندفع أجراً ولا نحدّد شروط عمل. صاحب العمل الأمريكي وحده هو المسؤول القانوني عن التوظيف.
- لسنا مكتب محاماة ولا نقدّم استشارة قانونية في الهجرة. لا شيء في المنصّة يُعدّ رأياً قانونياً، ولا تنشأ علاقة موكّل بمحامٍ باستخدامها. لتمثيل قانوني، راجع محامي هجرة مرخّصاً أو ممثّلاً معتمداً من EOIR.
- لسنا جهة حكومية ولا تابعين لأي جهة حكومية أمريكية، ولا لوزارة الخارجية ولا لـ USCIS ولا لوزارة العمل.
- لسنا جامعة ولا نمنح قبولاً أكاديمياً.
٢. التأشيرات وقرارات الهجرة
- قرار منح أي تأشيرة أو رفضها يعود حصراً إلى الجهات الأمريكية المختصة: القنصلية أو السفارة، وUSCIS، ووزارة العمل، وضابط الجوازات عند المنفذ. لا نملك أي تأثير على أيّ منها.
- لا نضمن الحصول على تأشيرة، ولا مدة إجراء، ولا نتيجة، ولا موعد مقابلة.
- «شارة كفالة التأشيرة» على أي إعلان تعني فقط أن صاحب العمل صرّح بنيّته وقت النشر. ليست وعداً ولا ضماناً ولا التزاماً منّا.
- عدد التأشيرات في برامج مثل H-2B محدود بسقف سنوي فيدرالي. استيفاء كل الشروط لا يعني توفّر تأشيرة.
- لا تدفع لأي شخص مقابل «ضمان» تأشيرة. من يَعِدك بذلك يكذب عليك — أياً كان، وسواء ادّعى صلة بنا أم لا.
٣. ما تدفعه أنت وما يدفعه صاحب العمل
هذا القسم هو الأهم في الوثيقة. اقرأه كاملاً.
٣.١ رسم خدمات المنصّة
تتقاضى المنصّة مئة دولار أمريكي (١٠٠ $) مقابل خدمات المنصّة: تحويل السيرة الذاتية إلى صيغة مقروءة آلياً (ATS)، وبناء الملف المهني، ومطابقته مع الشواغر المتاحة، وإيصال طلبك إلى صاحب العمل. الرسم يُدفع عبر مزوّد الدفع ولا يمرّ برقم بطاقتك على خوادمنا.
- الرسم مقابل عمل تقوم به المنصّة — لا مقابل وظيفة، ولا مقابل قرار حكومي، ولا مقابل أفضلية على متقدّم آخر.
- دفع الرسم لا يزيد فرصتك في الاختيار. الترتيب يقوم على المهارة والخبرة والتعليم واللغة والتوافر والموقع فقط.
- لا يُخصم أي مبلغ من أجرك إطلاقاً — لا من قبلنا ولا من قبل صاحب العمل نيابةً عنّا.
إفصاح واجب: القانون الفيدرالي الأمريكي يمنع في برامج معيّنة تحميل العامل أي تكلفة تتعلق بالحصول على العمل. إذا كان توظيفك ضمن برنامج H-2A أو H-2B، أو كان في ولاية تحظر ذلك، فإن رسم الخدمات لا يُستوفى منك، وإن استُوفي بالخطأ يُردّ إليك كاملاً. تفاصيل ذلك في البند ٤.
٣.٢ ما يدفعه صاحب العمل
تكاليف التجنيد والخدمات القانونية والإدارية ورسوم الالتماس الحكومية هي مسؤولية صاحب العمل وتُفوتر منه مباشرة. لا يجوز له تحميلك إياها بأي صورة: لا مقدَّماً، ولا خصماً من الأجر، ولا «قرضاً» يُسدَّد لاحقاً.
٣.٣ الاسترداد
- يُردّ الرسم كاملاً إذا لم تُقدَّم الخدمة — كأن يُسحب الإعلان قبل معالجة ملفك، أو يتعذّر علينا تنفيذ الخدمة لسبب يعود إلينا.
- يُردّ الرسم كاملاً إذا تبيّن أن القانون يمنع استيفاءه في حالتك (البند ٤)، ولو بعد تقديم الخدمة.
- لا يُردّ لمجرد عدم اختيارك من صاحب العمل، لأن الخدمة تكون قد أُدّيت فعلاً.

٤. حظر رسوم التجنيد — القواعد التي تحكمنا
القانون الأمريكي يحمي العامل الأجنبي من تحميله تكاليف الحصول على العمل. القواعد التي تعنيك:

٥. تسجيل مقاولي العمالة الأجنبية
عدد من الولايات يشترط تسجيل من يجنّد عمالة أجنبية للعمل داخلها، مع سند ضمان وإفصاحات مكتوبة. تعمل المنصّة في الولايات المسجّلة فيها فقط، وأرقام التسجيل:
- الولايات المسجّل فيها: تُملأ قبل النشر
- أرقام التسجيل وسندات الضمان: تُملأ قبل النشر
٦. مكافحة الاتجار بالبشر والعمل القسري
هذا ليس بنداً شكلياً. المنصّة تلتزم بقانون حماية ضحايا الاتجار (TVPA) وتعديلاته، وتحظر على كل صاحب عمل وكل شريك:
- حجز جواز سفرك أو أي وثيقة هوية. لا يجوز لأي شخص أن يحتفظ بجواز سفرك — لا صاحب العمل، ولا الوكيل، ولا نحن. جوازك يبقى بحوزتك دائماً.
- الدين المُقيِّد. لا يجوز إلزامك بدين أو «سلفة تجنيد» تُقيّد قدرتك على ترك العمل.
- منعك من الاستقالة. يحقّ لك ترك العمل في أي وقت وفق شروط عقدك، وقد يؤثر ذلك في وضع تأشيرتك — لكنه حقّك، ولا يجوز منعك منه بالتهديد ولا بحجز الوثائق ولا بالغرامة.
- عقد مختلف عمّا وُعدت به. لك أن ترفض التوقيع، وأن تبلغنا فوراً.
إن كنت في خطر أو تعرّضت لأي ممّا سبق: الخط الوطني الأمريكي للاتجار بالبشر 1-888-373-7888 — مجاني وسرّي وعلى مدار الساعة وبلغات متعددة. وقسم الأجور والساعات بوزارة العمل: 1-866-487-9243. الاتصال بهما لا يتطلب وضعاً قانونياً معيّناً.
٧. تكافؤ الفرص وعدم التمييز
- تُدار الوظائف على المنصّة دون تمييز على أساس العرق أو اللون أو الدين أو الجنس (بما فيه الحمل والتوجّه الجنسي والهوية الجندرية) أو الأصل القومي أو السن أو الإعاقة أو المعلومات الجينية — وفق Title VII وADA وADEA وGINA.
- ويحظر INA §274B التمييز على أساس وضع المواطنة أو الجنسية في التوظيف. لا يجوز لصاحب عمل أن يطلب وثائق بعينها لإثبات الأهلية للعمل ولا أن يرفض وثيقة صحيحة.
- محرّك المطابقة لدينا يستخدم المهارة والخبرة والتعليم واللغة والتوافر والموقع فقط. لا يستخدم الجنسية ولا العرق ولا الدين ولا الجنس ولا السن ولا الحالة الاجتماعية. ونتيجته إرشادية ولا تتخذ أي قرار توظيف — القرار بشري دائماً.
- للشكوى من تمييز: لجنة تكافؤ فرص العمل EEOC على 1-800-669-4000، أو مكتب IER بوزارة العدل للتمييز على أساس المواطنة.
٨. الأجر وساعات العمل
- الأجر المعروض في أي إعلان هو ما صرّح به صاحب العمل، وقد يخضع لأجر سائد تحدّده وزارة العمل في البرامج التي تشترطه.
- يسري الحد الأدنى الفيدرالي للأجر وقواعد العمل الإضافي، وقد يكون الحد في ولايتك أعلى — فيسري الأعلى.
- لا يجوز أي خصم من أجرك لصالح المنصّة. وأي خصم آخر يجب أن يكون قانونياً ومُفصَحاً عنه كتابةً قبل بدء العمل.
- يجب أن تتسلّم عرض عمل مكتوباً يبيّن الأجر وساعات العمل ومكانه ومدته قبل أي سفر.
٩. السلامة والحق في الشكوى
- يحقّ لك مكان عمل آمن وفق قانون OSHA، وأن تُبلّغ عن خطر دون انتقام.
- الانتقام محظور. لا يجوز فصلك ولا تهديد تأشيرتك ولا تخفيض أجرك لأنك اشتكيت أو تعاونت مع تحقيق حكومي.
- إن انتُقم منك، أبلغنا على legal@dreambridgeusa.com وأبلغ الجهة المختصة. ونحن نوقف تعاملنا مع صاحب العمل عند ثبوت ذلك.
١٠. التزامات صاحب العمل تجاهنا
باستخدام المنصّة، يقرّ صاحب العمل ويضمن:
- أنه كيان قانوني قائم ومخوّل بالتوظيف في الولايات المتحدة، وأن كل إعلان يمثّل شاغراً حقيقياً بشروط حقيقية.
- أنه لا يستوفي ولن يستوفي من العامل أي رسم تجنيد، ولا يسمح لوكيل بذلك، وأنه سيضمّن عقوده مع المجنّدين الحظر التعاقدي المطلوب نظاماً.
- أنه لن يحجز وثائق هوية أي عامل.
- أنه يفصح لنا عن كل وكيل أو مجنّد يستعين به، وبيانات التواصل معه، حين يُطلب ذلك نظاماً.
- أنه يلتزم بقوانين الأجور والسلامة وعدم التمييز الفيدرالية وقوانين ولايته.
مخالفة أيّ ممّا سبق تُنهي الحساب فوراً، وقد نُبلّغ الجهة المختصة.
١١. مسار الدراسة
- قرار القبول الأكاديمي وإصدار نموذج I-20 يعودان للجامعة وSEVP وحدهما. لا نضمن أياً منهما.
- بيانات الجامعات (الرسوم والمواعيد ونسب القبول) مأخوذة من مصادر معلنة، ويظهر لكل سجل تاريخ آخر تحديث. تحقّق دائماً من الموقع الرسمي للجامعة قبل أي قرار مالي.
- العمل أثناء الدراسة بتأشيرة F-1 مقيّد بقواعد SEVP. لا تعتمد على دخل عمل لتغطية دراستك.
١٢. الرسائل داخل المنصّة
- تُفتح قناة رسائل بينك وبين الشركة بعد تقديم طلبك. اسمك الكامل يبقى محجوباً عنها حتى ترشّحك.
- لا تنقل المحادثة خارج المنصّة. خارجها لا يوجد سجل ولا حماية ولا إثبات لما وُعدت به.
- يجوز للإدارة الاطّلاع على المحادثات لأغراض السلامة ومنع الاحتيال، وكل اطّلاع يُسجَّل في سجل التدقيق. والنظام ينبّه تلقائياً عند طلب مال خارج المنصّة أو تبادل وسائل تواصل خارجية.
- إن طُلب منك مال أو طُلب الانتقال إلى تطبيق آخر، فأبلغ فوراً على report@dreambridgeusa.com.
١٣. القانون الحاكم وحل النزاع
- تخضع هذه الأحكام لقوانين ولاية تُملأ قبل النشر والقانون الفيدرالي الأمريكي، دون اعتبار لقواعد تنازع القوانين.
- يُحاول حلّ أي نزاع ودّياً أولاً خلال ٦٠ يوماً من إشعار مكتوب إلى legal@dreambridgeusa.com.
- التحكيم: صيغة التحكيم وحق الانسحاب منه يحدّدهما محاميك. ولا يشمل أي شرط تحكيم — ولا يجوز أن يشمل — دعاوى الاتجار بالبشر أو العمل القسري أو الأجور غير المدفوعة أمام الجهات الحكومية.
- لا يمنعك أي بند في هذه الوثيقة من تقديم شكوى إلى وزارة العمل أو EEOC أو OSHA أو أي جهة حكومية، ولا من التعاون مع تحقيق. أي بند يخالف ذلك باطل.
١٤. حماية المستهلك والاشتراكات
- رسم الخدمات دفعة واحدة لكل طلب، وليس اشتراكاً متجدّداً. لا يُجدَّد تلقائياً ولا يُخصم منك مبلغ ثانٍ دون طلبك.
- تصلك بعد كل دفعة رسالة بالمبلغ والمرجع وتاريخ الدفع.
- سكّان بعض الولايات لهم حقوق إضافية في الإلغاء والاسترداد بموجب قوانين ولاياتهم، وهذه الوثيقة لا تنتقص منها.
١٥. الملكية الفكرية والمحتوى
- مستنداتك ملكك. برفعها تمنحنا ترخيصاً محدوداً لمعالجتها وعرضها على من يحقّ له وحده، لغرض خدمتك فقط، وينتهي بحذفها.
- محتوى المنصّة وتصميمها وعلامتها مملوكة لنا.
- لبلاغات حقوق النشر وفق DMCA: dmca@dreambridgeusa.com — وكيل التبليغ المسجّل: يُملأ قبل النشر.
١٦. إتاحة الوصول
نسعى لمطابقة WCAG 2.1 AA بما ينسجم مع ADA. إن واجهت حاجزاً يمنعك من استخدام أي جزء من المنصّة، أبلغنا على access@dreambridgeusa.com ونعالجه ونوفّر لك بديلاً للوصول إلى الخدمة.
١٧. القاصرون
الخدمة ليست موجّهة لمن هم دون ١٨ عاماً، ولا نجمع بياناتهم عن قصد. إن علمنا بحساب لقاصر حذفناه. أولياء الأمور: privacy@dreambridgeusa.com
١٨. تعديل هذه الأحكام
قد نعدّلها. أي تعديل جوهري يُبلَّغ به عبر البريد وداخل المنصّة قبل ٣٠ يوماً من سريانه، ويُذكر تاريخ آخر تحديث أعلى الصفحة. استمرارك في الاستخدام بعد السريان قبولٌ بالتعديل.

This document is an operational template. It was not prepared by a lawyer, and it must be reviewed by counsel licensed in the United States and in every state the platform operates in before commercial launch. Anything marked like this must be filled in before publication.
These terms are read together with the Terms of Use and the Privacy Policy, and govern everything relating to employment or study inside the United States. Where they conflict, this document controls on U.S. matters.
1. Who we are — and who we are not
DreamBridgeUSA is an independent private company providing technology platform services. To leave no room for doubt:
- We are not an employer. We hire nobody, pay no wages and set no working conditions. The U.S. employer alone carries the legal responsibility for employment.
- We are not a law firm and we do not give immigration legal advice. Nothing on the platform is a legal opinion, and using it creates no attorney–client relationship. For representation, consult a licensed immigration attorney or an EOIR-accredited representative.
- We are not a government agency and are not affiliated with one — not the Department of State, not USCIS, not the Department of Labor.
- We are not a university and grant no admission.
2. Visas and immigration decisions
- Granting or refusing any visa rests solely with the competent U.S. authorities: the consulate or embassy, USCIS, the Department of Labor, and the officer at the port of entry. We have no influence over any of them.
- We do not guarantee a visa, a processing time, an outcome, or an interview date.
- A "visa sponsorship" badge on a listing means only that the employer stated that intention at posting time. It is not a promise, a guarantee, or a commitment by us.
- Programmes such as H-2B are subject to a federal annual cap. Meeting every requirement does not mean a visa is available.
- Never pay anyone for a "guaranteed" visa. Anyone who promises you one is lying to you — whoever they are, and whether or not they claim a connection to us.
3. What you pay, and what the employer pays
This is the most important section in the document. Read all of it.
3.1 The platform service fee
The platform charges one hundred U.S. dollars ($100) for platform services: converting your CV into a machine-readable (ATS) format, building your professional profile, matching it against available openings, and delivering your application to the employer. It is charged through our payment provider; your card number never reaches our servers.
- The fee pays for work the platform performs — not for a job, not for a government decision, and not for advantage over another applicant.
- Paying it does not improve your chances of selection. Ranking uses skills, experience, education, language, availability and location only.
- Nothing is ever deducted from your wages — not by us, and not by an employer on our behalf.
Required disclosure: U.S. federal law prohibits, in certain programmes, charging a worker any cost connected with obtaining employment. If your placement falls under H-2A or H-2B, or is in a state that prohibits it, the service fee is not collected from you, and if it is collected in error it is refunded in full. See section 4.
3.2 What the employer pays
Recruitment costs, legal and administrative services, and government petition fees are the employer's responsibility and are invoiced to the employer directly. The employer may not pass them to you in any form: not up front, not as a wage deduction, and not as a "loan" repaid later.
3.3 Refunds
- The fee is refunded in full where the service was not delivered — the listing is withdrawn before your file is processed, or we cannot perform the service for reasons attributable to us.
- The fee is refunded in full if it turns out the law prohibited charging it in your case (section 4), even after the service was performed.
- It is not refunded merely because an employer did not select you, because the service was in fact performed.
- Refund requests: within 30 days of payment, to refunds@dreambridgeusa.com
4. The recruitment-fee prohibition — the rules that bind us
U.S. law protects foreign workers from bearing the cost of obtaining work. The rules that concern you:

What we do about it: where a vacancy falls under a programme or a state to which the prohibition applies, no service fee is asked of you and your application is delivered free. If an amount was collected from you in a case where the prohibition applies, write to refunds@dreambridgeusa.com and it is returned in full, without conditions.
5. Foreign labor contractor registration
Several states require anyone recruiting foreign workers for work inside them to register, post a bond, and give written disclosures. The platform operates only in the states where it is registered:
- States registered in: to be completed before publication
- Registration numbers and surety bonds: to be completed before publication
6. Anti-trafficking and forced labour
This is not a formality. The platform commits to the Trafficking Victims Protection Act (TVPA) and its reauthorisations, and prohibits every employer and every partner from:
- Holding your passport or any identity document. Nobody may keep your passport — not the employer, not an agent, not us. It stays with you, always.
- Debt bondage. You may not be bound by a debt or a "recruitment advance" that restricts your ability to leave a job.
- Preventing you from resigning. You may leave a job at any time under the terms of your contract. It may affect your visa status — but it is your right, and it may not be blocked by threats, document confiscation, or a penalty.
- A contract different from what you were promised. You may refuse to sign it, and you should tell us immediately.
If you are in danger or any of the above has happened to you: the U.S. National Human Trafficking Hotline, 1-888-373-7888 — free, confidential, 24 hours, many languages. The Department of Labor Wage and Hour Division: 1-866-487-9243. Neither requires any particular immigration status to call.
7. Equal opportunity and non-discrimination
- Jobs on the platform are handled without discrimination on the basis of race, colour, religion, sex (including pregnancy, sexual orientation and gender identity), national origin, age, disability or genetic information — under Title VII, the ADA, the ADEA and GINA.
- INA §274B additionally prohibits discrimination on the basis of citizenship or immigration status in hiring. An employer may not demand specific documents to prove work authorisation, nor reject a valid one.
- Our matching engine uses skills, experience, education, language, availability and location only. It does not use nationality, race, religion, sex, age or marital status. Its score is advisory and makes no hiring decision — a human always does.
- To complain about discrimination: the EEOC on 1-800-669-4000, or the Department of Justice IER section for citizenship-status discrimination.
8. Wages and hours
- The wage shown on a listing is what the employer stated, and may be subject to a prevailing wage set by the Department of Labor in programmes that require one.
- The federal minimum wage and overtime rules apply, and your state's minimum may be higher — the higher one applies.
- No deduction from your wages may be made for the platform. Any other deduction must be lawful and disclosed to you in writing before work begins.
- You must receive a written offer stating pay, hours, place and duration before any travel.
9. Safety and the right to complain
- You are entitled to a safe workplace under OSHA, and to report a hazard without retaliation.
- Retaliation is prohibited. You may not be dismissed, threatened with your visa, or have your pay cut because you complained or cooperated with a government investigation.
- If you are retaliated against, tell us at legal@dreambridgeusa.com and tell the authority. We end our relationship with an employer where this is established.
10. The employer's obligations to us
By using the platform, an employer represents and warrants:
- That it is a validly existing legal entity authorised to employ in the United States, and that every listing is a real vacancy on real terms.
- That it does not and will not collect any recruitment fee from a worker, permits no agent to do so, and will include the contractually required prohibition in its agreements with recruiters.
- That it will not hold any worker's identity documents.
- That it will disclose to us every agent or recruiter it engages, and their contact details, where the law requires it.
- That it complies with federal and state wage, safety and non-discrimination law.
Breach of any of the above ends the account immediately, and we may report it to the competent authority.
11. The education track
- Academic admission and issuance of the I-20 rest with the university and SEVP alone. We guarantee neither.
- University data (tuition, deadlines, acceptance rates) comes from published sources, and each record shows when it was last updated. Always confirm on the university's official site before any financial decision.
- Work during study on an F-1 visa is restricted by SEVP rules. Do not rely on work income to fund your studies.
12. Messaging on the platform
- A message channel opens between you and the company after your application is submitted. Your full name stays hidden from them until they shortlist you.
- Do not move the conversation off the platform. Outside it there is no record, no protection, and no proof of what you were promised.
- Administrators may read conversations for safety and fraud prevention, and every such read is written to the audit log. The system automatically raises a flag when money is requested outside the platform or outside contact details are exchanged.
- If you are asked for money, or asked to move to another app, report it at once to report@dreambridgeusa.com.
13. Governing law and dispute resolution
- These terms are governed by the laws of the State of to be completed before publication and U.S. federal law, without regard to conflict-of-laws rules.
- Any dispute is first addressed informally, within 60 days of written notice to legal@dreambridgeusa.com.
- Arbitration: the arbitration clause and its opt-out are for your counsel to settle. No arbitration clause covers — and none may cover — claims of human trafficking, forced labour, or unpaid wages before a government agency.
- Nothing in this document prevents you from filing a complaint with the Department of Labor, the EEOC, OSHA or any government agency, or from cooperating with an investigation. Any clause purporting otherwise is void.
14. Consumer protection and billing
- The service fee is a single charge per application, not a subscription. It does not auto-renew, and no second amount is taken without your request.
- After every payment you receive a message stating the amount, the reference and the date.
- Residents of some states have additional cancellation and refund rights under their own state law, and this document does not reduce them.
15. Intellectual property and content
- Your documents are yours. Uploading them grants us a limited licence to process them and show them only to those entitled to see them, for the purpose of serving you, ending when you delete them.
- The platform's content, design and mark belong to us.

16. Accessibility
We aim to meet WCAG 2.1 AA, consistent with the ADA. If you meet a barrier that stops you using any part of the platform, tell us at access@dreambridgeusa.com; we will address it and provide you an alternative route to the service.
17. Minors
The service is not directed to anyone under 18 and we do not knowingly collect their data. If we learn of a minor's account we delete it. Parents and guardians: privacy@dreambridgeusa.com
18. Changes to these terms
We may change them. Any material change is notified by email and inside the platform 30 days before it takes effect, and the last-updated date at the top of this page changes with it. Continuing to use the service after it takes effect is acceptance.
